The terms that apply to this website and to communications with Betancourt Kotenai PLLC.
1. Acceptance of these terms
By using bklawwa.com (the “Site”) you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.
2. The Site is not legal advice
The content on this Site is general information about the law and about our firm. It is not legal advice, it may not reflect the most current legal developments, and it may not apply to your situation. Do not act or refrain from acting on the basis of anything on this Site without consulting a lawyer about your specific circumstances.
3. No attorney–client relationship
Using the Site, sending a message through it, calling the office, or scheduling a consultation does not create an attorney–client relationship between you and Betancourt Kotenai PLLC. An attorney–client relationship is formed only after we have completed a conflict check, you have consulted with a licensed attorney directly, rendered payment, and both you and the attorney have signed an engagement letter. Please do not send confidential information through the Site.
4. No guarantee of results
Descriptions of our practice areas, experience, and approach are not promises about the outcome of any matter. Every case depends on its own facts and law. Prior results do not guarantee a similar outcome.
5. Text messaging (SMS) terms
Program. Betancourt Kotenai PLLC uses text messaging to communicate with clients and prospective clients about appointments, scheduling, documents, and their matters (the “Program”). We do not send marketing text messages.
Consent. By providing your mobile number and agreeing to receive text messages — on a form, in writing, or by texting us first — you consent to receive messages from us under the Program. Consent is not a condition of any purchase or of legal representation.
Frequency and cost. Message frequency varies depending on your matter. Message and data rates may apply. Contact your wireless carrier for details about your plan.
Opting out. Reply STOP to any message to stop receiving texts from us. You will receive one final confirmation message. You may also opt out by calling (509) 317-8184.
Help. Reply HELP to any message, or call (509) 317-8184, for assistance.
Carriers. Wireless carriers are not liable for delayed or undelivered messages. Text messaging may not be available on all carriers or devices.
Privacy. Mobile numbers and text-message opt-in data are handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
6. Communications and the contact form
You agree to provide accurate contact information. You agree not to use the Site or the contact form to send unlawful, harassing, or abusive content, or to send information on behalf of another person without authority. We may decline to respond to any message.
7. Intellectual property
The Site, including its text, design, logo, and graphics, is owned by Betancourt Kotenai PLLC or its licensors and is protected by copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not copy, republish, or use the Site’s content or the firm’s name or logo for any other purpose without our written permission.

The Site may link to third-party sites and services, including mapping and scheduling tools. We do not control those sites, we are not responsible for their content or practices, and a link does not mean we endorse them. Your use of a third-party site is governed by its own terms.
9. Disclaimer and limitation of liability
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Betancourt Kotenai PLLC disclaims all warranties, express or implied, regarding the Site and its content, and will not be liable for any damages arising from your use of, or inability to use, the Site. Nothing in these terms limits the duties we owe to clients under an engagement agreement or the rules of professional conduct.
10. Governing law
These terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. Any dispute concerning the Site shall be brought in the state or federal courts located in Benton County, Washington.
11. Changes to these terms
We may update these terms from time to time. The effective date at the top of the page will change when we do. Continued use of the Site after a change means you accept the updated terms.
